Chapter 7
Under Chapter 7, your unsecured debts, such as personal loans and credit card debts, among others, are discharged or forgiven.
Mortgages, car loans, conditional sales on household goods, mortgages on building materials, student loans, alimony, and taxes from the last four years are not dischargeable. Discharging unsecured debts that were straining your budget will free up disposable income to improve your quality of life.
The debtor will file the petition alone or with their spouse, or if they are not legally married, both individuals may file separate petitions and request consolidation of their cases. They will submit information sheets on their assets and debts and request the exemptions applicable under Federal Law to protect their essential assets. They must also submit evidence of the value of their home, car, and debt balance.
