Damages and Torts
In Puerto Rico, unlike other US jurisdictions, we have a Civil Code that contains basic principles that systematically govern the social life of our people.
In this regard, the Code establishes the sources of obligations in Puerto Rico, namely: law, contracts, quasi-contracts, and unlawful acts or omissions involving any kind of fault or negligence.
The fourth source of obligations—unlawful acts or omissions involving any kind of fault or negligence—is what is legally referred to as non-contractual civil liability and is commonly known as liability for damages.
